GTC UPDATE:  The right to privacy is now a fundamental human right in India

India’s Supreme Court has unanimously ruled that the right to privacy is a fundamental right because it is “an intrinsic part of right to life.”  The landmark 547-page judgment overrules two prior India Supreme Court decisions from 1954 and 1962.  The case involves challenges to India’s biometric-based identification number system (the “Adhaar scheme”), which was purportedly designed to increase social inclusion and improve the accessibility of government services.  The system is mandatory for certain government services, which raised privacy concerns.  The Adhaar scheme will now be further reviewed, and the decision may have broader impacts as well, beyond the particular […]

HiQ scrapes LinkedIn data to help employers retain and identify talent.  LinkedIn has accused hiQ of violating LinkedIn’s user agreement and alleges that any circumvention of LinkedIn IP address blocking would violate the Computer Fraud and Abuse Act, the Digital Millennium Copyright Act and California law.  LinkedIn, which was acquired by Microsoft in 2016 for $26 billion, may have been prompted to take action against hiQ due to Microsoft’s plan to leverage LinkedIn data for analytics. GTC UPDATE: Canadian Jurisdiction Over US Websites

With implications for US websites, two recent controversial Supreme Court of Canada decisions indicate that Canadian courts may be more aggressively asserting jurisdiction in disputes arising on the internet.  In Douez v. Facebook, Inc., 2017 SCC 33 (June 23, 2017), the Court declined to enforce a choice of forum clause in Facebook’s terms of use and permitted a privacy lawsuit to proceed in British Columbia.  In Google Inc. v. Equustek Solutions Inc., 2017 SCC 34 (June 28, 2017), the Court granted an injunction that extended beyond Canadian borders, prohibiting Google from displaying certain infringing material. In Douez, Facebook allegedly used […]
